Terms of use
Last updated 17 October 2026
These terms apply to your use of the SafeEater website and app ("SafeEater"), operated by Saul Aaron Hirner (ABN 19 159 463 363) ("we", "us"). By using SafeEater you agree to these terms and to our privacy policy. If you don't agree, please don't use SafeEater.
1. SafeEater is not a safety guarantee
Please read this section carefully. SafeEater shows ratings, reviews and peanut-safety information submitted by other users about their own experiences. It is opinion, not verified fact.
- We do not inspect, test, certify or verify any restaurant, menu, dish, ingredient or review.
- A "Safe" rating or any other information on SafeEater is not a guarantee, certification or warranty that any food is free of peanuts or safe for you to eat.
- Recipes, suppliers and kitchen practices change without notice, and cross-contact is always possible.
- SafeEater is not medical advice. Before ordering or eating anything, you must confirm allergen information directly with the restaurant, every time. Carry your prescribed emergency medication and follow your doctor's advice.
2. Your account
- You must be at least 16 years old to create an account.
- Give accurate information and keep your password secure. You are responsible for activity on your account.
- You can delete your account at any time from your profile.
3. Reviews and other content you post
When you post a review or rating, you agree that:
- It is honest and based on your own first-hand experience at that restaurant.
- You are not the owner, an employee or a competitor of the restaurant, and you have not been paid or rewarded for the review (other than SafeEater XP).
- It does not contain anything false or misleading, defamatory, abusive, hateful, harassing, or anyone else's personal information.
- It does not infringe anyone else's rights.
You keep ownership of your content. You give us a non-exclusive, worldwide, royalty-free licence to host, display, reproduce and use it to operate and promote SafeEater, including in calculating restaurant ratings. This licence ends when you delete the content or your account, except where it has already been used in materials we can't reasonably change.
We may remove or edit content, or suspend or close accounts, that we reasonably believe breach these terms or put others at risk. If you think content on SafeEater is wrong or breaches these terms, email saulhirner@gmail.com.
4. Acceptable use
You must not:
- Use SafeEater for anything unlawful, or to mislead other users about allergen safety.
- Create fake accounts or reviews, or manipulate ratings.
- Scrape, copy or collect data from SafeEater by automated means, or interfere with its security or operation.
- Impersonate anyone else.
5. Google Maps
SafeEater uses Google Maps and Google Places. By using SafeEater you also agree to the Google Maps/Google Earth Additional Terms of Service and acknowledge the Google Privacy Policy. Restaurant names, addresses and other place details come from Google and may be incomplete or out of date.
6. The service
SafeEater is provided free of charge, as is and as available. We may change, suspend or stop any part of it at any time. We don't promise it will always be available, accurate or error-free.
7. Liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Subject to that, and to the fullest extent permitted by law, we are not liable for any illness, injury, allergic reaction, loss or damage arising from your use of SafeEater, from information on it, or from relying on that information, including content posted by other users. Where our liability can be limited but not excluded, it is limited to supplying the service again.
8. Changes to these terms
We may update these terms. We will update the date at the top of this page, and if a change is significant we will let you know in the app or by email. If you keep using SafeEater after a change, you accept the updated terms.
9. Governing law
These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
